It is an order which is made in a county court.In general, the administration orders will be issued when the debtor has multiple debts and it is believed that bankruptcy could be avoided. It focuses on the administration of the estate of a judgment debtor.The debtor is required to pay the debts by instalments based on the order.The creditor however unable to enforce the individual claims by different methods without permission of the court.
Administration order is also governed by insolvency Act 1986. It involves in the situation where a company in a financial difficulties hoping to secure its survival as a going concern or to achieve a more favourable realization of the assets. The enforcement of the order will lead to the affairs of the company being managed by an administrator. The creditors unable to bring legal action to wind up the business.
The possibility of out of court administration is possible. The company or the director or even the floating charge holder can appoint an administrator.
